ASSOCIATION MEETING - JUNE 22, 2000

CALL TO ORDER

The meeting was called to order by Board President John Poland at 7:00 p.m.

ATTENDANCE

Board Members present were John Poland, Andy Kemppainen, Mark Pyles and Michelle Yerkeson. Also present were Char Ostholthoff and Mark Weinberg, representing Towne Properties. Scott Puckett was absent from the meeting.

BOARD CHANGES

John Poland announced the appointment of Michelle Yerkeson to the Board of Trustees to fulfill the term vacated by Pat Mitra.

PROPERTY MANAGEMENT CHANGES

John Poland announced the resignation of Terry Baute from Towne Properties and the appointment of Mark Weinberg as Property Manager representative for Towne Properties.

MANAGEMENT REPORT

Financial Report

Mark Weinberg stated cash of $11,523.18 in the operating fund and $2,809.55 in a reserve fund.

Total income for May was $294.46. Total income for the period 10/99 through 05/00 was $25,084.52.

Total expenses for May were $3,689.81. Total expenses for the period 10/99 through 05/00 were $13,561.74.

The association is $2,331.17 under budget from 10/99 through 05/00.

Delinquencies

There are 6 property owners who are delinquent in the payment of their Association dues, and a lien has been placed on those properties. Each property owner received 3 letters prior to placing the lien.

Question from the floor: What is the status of foreclosure on 8079 Summer View Drive?
Response: John has asked Towne to check status of the aforementioned foreclosure. Char advises foreclosures take about 9 months.

Question from the floor: Who is picking up the newspapers for this property?
Response: Various neighbors.

APPROVAL OF MEETING MINUTES

John Poland made a motion to approve the March 23, 2000 meeting minutes. 4 members in favor of approving the minutes, 0 members not in favor. Motion carried unanimously.

OLD BUSINESS

Treasurers Report

Andy Kemppainen stated $11,523.18 is available for operating expenses, plus $2,809.05 in a reserve account. Additionally, Accounts Receivable total $1,311.80, which bring total assets to $15,644.03. The Association is currently under budget by approximately $2,500.

The Association spent $1375.40 in management fees and signage improvement. Also noted that approximately $950.00 of the $1,015.86 spent for electricity was for the meter installation at the Socialville-Fosters Road entrance.

CG&E Meter @ Socialville-Fosters Entrance

The application for the electric meter for the Socialville-Fosters Road entrance has been approved and has been forwarded to CG&E’s construction division. The meter should be installed sometime the week of 6/25/00.

Dead Tree Replacement - Falling Leaves Court

Near and around the retention pond on Falling Leaves Court - Ryland advises that these trees are beyond the warranty and are the responsibility of the Owner’s Association to replace if desired.

Concrete Removal

The slab of concrete left near the retention pond has been removed.

Debris Removal

Char spoke to Classic Properties and Doug Larrick of Deerfield Township about the debris behind the homes on Falling Leaves Court and Winters Lane. The developer has been given permission to leave the debris until the current project is complete. There is a performance bond in place to assure the debris is removed.

Shed Issue Update

The makeshift shed on the property at Summer View and Socialville-Fosters Road has been removed after Terry Baute discussed the problem with the property owner. Also, a fence has been added.

NEW BUSINESS

Broken Street Lights

Michelle Yerkeson has provided Towne Properties with a list of broken/malfunctioning streetlights

Property in Foreclosure

The ranch house @ 8679 Summer View is in foreclosure. Towne Properties is looking into the status of the foreclosure, and when the Association can expect the house to become available.

Election Committee

John & Michelle’s board terms are due to expire in September 2000. John does not intend to run for re-election.

Request issued for volunteers from the Association to form an election committee (at least 2 needed). This committee would solicit nominees; issue ballots and oversee the election. There were no volunteers forthcoming.

John Poland volunteered to chair the election committee, with Mark Weinberg - Towne Properties as his contact. Nominee profiles and proxy ballots are to mail out at least 30 days prior to the Associations annual meeting in September.

OPEN FORUM

Question from the floor: What can be done about the trees at the Butler-Warren Road entrance, which are obstructing the view at the stop sign when turning left?
Response: Towne Properties is to contact Emmaculawn with a request to trim back the trees and shrubs in the common area at this intersection.

For the trees and/or shrubs on personal property, Article 10 of the Protective Covenants and Restrictions provides for clear line of sight around intersections. Owners are invited to write letter of complaint to Towne Properties.

Question from the floor: What can be done about the house on the corner of Summer View and Spring Arbor Drives with weeds in backyard?
Response: Write letter of complaint to Towne Properties.

Question from the floor: When will Autumn Place be paved?
Response: The pavement is marked, so it should be soon.

Question from the floor: Can we mention "dog walking etiquette" in the next newsletter?
Response: Yes.

Question from the floor: 6591 Falling Leaves Court has not landscaped or maintained the back yard.
Response: Write a letter of complaint to Towne Properties.

Question from the floor: What can be done about not getting the quarterly newsletter?
Response: Call Mark Weinberg @ Towne Properties to make sure your records are current.

Question from the floor: Is there a "no solicitation" policy in force for the neighborhood?
Response: Yes, Deerfield Township has a "no solicitation without permit" policy. Contact the Township.

Question from the floor: Who maintains the entrances to the subdivision?
Response: The association maintains both entrances. There is no landscaping easement along Socialville-Fosters & Butler-Warren Road and as such, is the responsibility of the individual homeowner. The Association cannot maintain these areas without an easement given by the individual property owners.

Question: Can we plant perennials and other flowers at the Butler-Warren Road entrance?
Response: We can, but it would be harder to keep irrigated because there is no direct water access to the area.

Question: Has Section Five been dedicated?
Response: No, not until the streets are done. Once Section Five has been inspected by and dedicated to the county the performance bond being held will be returned to the developer.
