1. All lots in this subdivision shall be for residential purposes only. No building shall be erected, altered, placed, or permitted to remain on any of these lots other than one detached single family dwelling, not to exceed two (2) stories in height and a private garage for not more than two (2) cars. 2. No more than one (1) single family dwelling shall be placed on any one lot. 3. On all lots, no building shall be set closer than forty (40) feet to the front lot line. The minimum side yard to any interior side line shall be five (5) feet, with a total of both side yards to be a minimum of fourteen (14) feet. 4. No structure of a temporary character, trailer, basement, tent, shack, garage or other outbuilding shall be used on any lot at any time as a residence, either temporarily or permanently. 5. No noxious or offensive activity shall be carried on upon any lot, nor shall anything be done thereon which may be or become an annoyance to the neighborhood. 6. No animals, livestock or poultry of any kind shall be raised, bred or kept, except dogs, cats, or household pets may be kept, provided that they are not kept, bred, or maintained for any commercial purpose. 7. No sign of any kind shall be displayed to the public view on any lot except one professional sign of not more than five (5) square feet, advertising the property for sale, or signs used by the builder to advertise the property. 8. No lot shall be used as a dumping ground; trash, garbage or other waste shall not be kept except in sanitary containers. All incinerators or other equipment for the disposal or storage of such material shall be kept in a clean and sanitary condition. 9. No fence or wall shall be erected, placed or permitted on any lot nearer to any street than the minimum setback line. 10. No hedge or other planting or other planting which obstructs sight lines of elevation between two (2) and six (6) feet above the roadways shall be placed or permitted to remain on any corner lot within the triangular area formed by street property lines and a line connecting them at points thirty (30) feet from the intersection of the street property lines extended. The same sight line limitations shall apply to any lot to within ten (10) feet from the intersection of a street property line with the edge of a driveway or alley pavement. No tree shall be permitted to remain within such distances of intersections unless the foliage is maintained at sufficient height to prevent obstruction of such sight lines. 11. Easements shown on the plat are for the construction, operation and maintenance, repair, replacement, or removal of water, gas, sanitary sewer, storm sewer and drainage, electric, telephone or other utility lines or services and for the express privilege of removal of any and all trees or other obstructions to the free use of said utilities and for providing of ingress and egress to the property for said purposes and are to be maintained as such forever. 12. No trucks over one (1) ton capacity shall at any time be parked in this subdivision except when in an enclosed garage. Trucks making service or delivery calls are hereby excluded from this restriction. 13. These convenants are to run with the land and shall be binding on all parties claiming under them for a period of twenty-five (25) years from the date convenants are recorded, after which time said convenants shall be automatically extended for successive periods of ten (10) years, unless an instrument signed by a majority of the then owners of the lots has been recorded, agreeing to change said covenants in whole or in part. 14. Enforcement shall be by proceedings at law in equity, against any person or persons violating or attempting to violate any convenant, either to restrain violating or to recover damages. 15. Invalidation of any one of these covenants by judgment or court order shall in no way affect any of the other provisions which shall remain in full force and effect. 16. The installation of a satellite dish by any lot owner must first receive from the Chestnut Oaks Home Owners Association as to location of said satellite dish.
